In the US it’s more of a state-by-state basis. Texas for example has SB20 which, while targeting AI generated child pornography, is worded in a way that would also target a manga hand-drawn in Procreate. Whether or not this was done on purpose is something you can decide for yourself.
The constitution applies in all states. The 14th amendment makes that explicit.
So here’s going to be an unpopular opinion. First let me preface this with I think hurting children is one of the worst things you can do. But is drawing a naked child illegal? Is a video game with a naked child 3d model illegal? Where is the line? Is it weird? Hell fucking yes. Is it wrong? I also believe yes. But it’s not an actual child. The real question should be, how did the AI know how to create those images? Because it was trained on actual child porn. And how this AI was trained should really be the crime. Because it ingested shit-tons of actual CSAM.
AI has not necessary been trained on CSAM. It may be able to generate it because it has both the concept of nakedness and the concept of children. Just like AI can generate flying dogs with wings and everything doesn’t mean it’s been trained on pictures of flying dogs.

It’s nearly an impossible question to answer in criminal scenario. An actual photo of an exposed minor is clearly harm to that individual. Putting their face on a fake but believable body is nearly as bad. Then you get to the sort of 5-10% gap where it could be them or inspired by them, but few would believe it’s an actual photograph. It all goes downhill from there. Cartoonify someone, give them bigger boobs and put them in a bikini on Mars and we start to wonder how this got to trial. It would be a huge gift to lawyers but I think most of this needs to play out in civil courts.
Controversial opinion: If there is no real child whose likeness is used to produce the image, then there is no real victim. The art that is created is of the same quality as a drawing from imagination.
The other problem with illegalizing content on the basis of whether it’s CSAM is the eternal question of whether an unreal likeness can be said to even have an age. How would you be able to prove with certainty that an AI-generated likeness was below the age of consent? You would think it would be obvious, but there is a huge gray area here. If the protection weren’t fairly strong, I 100% guarantee that conservative Bible-thumpers would take advantage of the opportunity to ban all ai pornographic content, and then move on to real porn after that.
In addition, Banning AI material we might be able to interpret as CSAM does nothing to protect real children. There is no empirical proof that any kind of porn has a real, independent effect on people’s sexual behavior.
Edit with addendum: In addition, civil rights are a matter of principle. It doesn’t matter whether the presence of AI generated material makes the job of policing more difficult. The Bill of Rights was created to try to make sure that we don’t become slaves. Just because something is highly offensive to my own tastes doesn’t mean that the civil rights of the person who offends me disappear.

And yes, it does harm children. allowing people to create, possess, and distribute CSAM, even if it’s AI-generated, will influence peoples willingness to act on their urges in real life, with real children. It’s not a stretch to consider that linkage. What you’re arguing for is shameful and disgusting.
Some people say it cold help preventing acting on those urges, unfortunately there’s no definitive answer especially because it’s not an easy-to-test topic.

It’s the same as when a chemical isn’t proven safe and businesses are not allowed to add it to your food. It may be completely safe, but just in case.
If the benefit of using something outweighs the risk it would be reasonable to allow it, but we are talking about something with no proven benefit other than letting pedos enjoy themselves.

The model knows what kids looks like and it knows what porn looks like. It is now more complex than the thought experiment, “the Chinese Room” because it can interpolate between two things it knows rather than basic request and response.
Were they also trained on the vast quantity of media of gymnasts made out of pasta for them to be able to create videos of that?
One of the main points of GenAI is the ability to smush multiple concepts together. There are plenty of training data of children that are in swimwear, or just literally naked that has nothing to do with CP, and there’s boatloads naked adults and of course, porn, it can successfully combine them together even if there was no actual CP in there whatsoever.
And given the internet’s proclivity toward legal “teen/jailbait” porn where the models are of age but focus heavily on child-like features/poses/clothing/etc, there’s literally millions of high-resolution photos that an inference machine could easily stitch together a CSAM image using nothing but legal source images.
And use of the model drives demand for it, just like purchasing real CSAM. Even if the subject is now 50 years old, it incentivizes abusers to make new material from people that are currently underage.

If you read the article, this is a very specific legal question. And honestly, it’s too gross to contemplate, and having a strong opinion about this on the internet is rightly suspicious.
The good news is the criminal in this case didn’t just posess CSAM, and no matter how this shakes out, they going to jail.
Having a firm conviction about realizing fundamental rights & liberties to their logical limits isn’t suspicious. Anything less is cowardice. The decision was sound.
I heard there is a theory from therapists that being able to create that content can help quell urges, and so we should allow it if it protects real kids, vile as it is. However others argue it could cause it cause more to cause harm.
Either way, the decision is well above my ability to decide, and while I would hope actual professionals would have a say, unfortunately it’s going to be a political thing. Pandoras box is wide open though.
This isn’t someone drawing CP though. It’s AI-generated CP, which means the model had to be actually trained on CP. You might argue that there are already models trained on CP, and the chicken is already in the nugget, but legalising it creates financial incentive to train on CP because then you can sell your model to paedophiles.
That’s not how AI works. The people claiming that AI models have to be trained on CP to make CP have a fundamental misunderstanding of how image generation models work.

So get rid of that dataset, you’ll still have systems that can generate similar images anyway. If it can generate images of things that do not and cannot exist in reality then it can generate CSAM without using real CSAM.
That doesn’t mean it has to be. It was, but that is a distinction. AI knows what children look like and AI knows what porn looks like. It is gross but it doesn’t mean there has to be a victim. There are, I’m sure, a ton of (pirated) medical journals and text books fed into many of them.

Or is it bad because of the source? It’s a whole can of worms that we won’t be able to come to a concensus here, too many grey areas.

You can’t have training data for it I guess? But then the model maker would have to break the law to even make it of course so you can’t even use that model without some laws being broken down the line. Then again virtually all models should be illegal because of that. I feel like there is a lot of legislation to be done here because the whole industry is rotten to the core.
The idea that CSAM is used in training data is largely discredited. An AI doesn’t need to have actual images of nude children to generate CSAM; it knows what humans look like naked, and it knows what children look like - it fills in the gaps from there.
There was an article the other day saying that Grok used CSAM as training data.
It’s important to note that to produce an AI-generated image of somebody, they do not need to exist in the training data beforehand. You can use an image as a prompt, and an AI can create new works based on that prompt, without ever referencing the person from training materials.
Most of these CSAM files are not readily available on the clearnet, and I don’t think even Elon is stupid enough to let an AI scraper run free on Tor. One would have to go significantly out of their way to locate clearnet sources of CSAM to include into the training data.
Some would say it’s a distinction without difference, but I think it’s important to understand how these AI images are actually created, if you want to adequately legislate them.
